Short, and meant to be read.

Who you are agreeing with
CuBid is operated by Rohan Vora, an individual based in India. Using the site, and paying on it, is an agreement with him. These terms are governed by the laws of India, and the courts of India have jurisdiction over any dispute arising from them.
Nothing in this clause takes away a right you have under the consumer law of the country you live in, and none of it affects your ability to raise a payment dispute with Dodo Payments or with your bank.
You must be 18 or older to post or to pay here.
Complaints about anything on this site go to the Grievance Officer, Rohan Vora, at hello@cubid.love. We acknowledge a complaint within 24 hours and resolve it within 15 days, as India's Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 require. Tell us the message and what is wrong with it; the report link on every message reaches us fastest.

Messages are public
Everything posted to CuBid is visible to anyone who visits, and each message has its own shareable page. Do not write anything here you would not want a stranger, a search engine, or the person named in it to read.
Paying moves a message up the page. It never makes a message private, and it never removes one.

What may not be posted
Content that attacks, demeans or dehumanises anyone on the basis of race, ethnicity, national origin, caste, religion, gender, gender identity, sexual orientation, disability, age or serious illness.
Slurs, harassment, bullying, threats of violence, or encouragement of self-harm.
Sexual content involving minors, or sexual content about an identifiable person who has not consented.
Another person's private information — phone numbers, addresses, workplaces, identity documents — or anything intended to make someone findable against their wishes.
Impersonation, spam, advertising, scams, or anything unlawful where you or the reader lives.

We can remove anything, at any time
We may hide or delete any message, and suspend any account, at our sole discretion and without prior notice. We do not have to explain a removal, and we do not have to wait for a report before acting.
A message that breaks the rules above will be removed. So will one that is technically within them but makes this a worse place to be.
Removal does not entitle you to a refund. Money paid on a message that is taken down is not returned.

Payments are final
All payments are final and non-refundable. This includes, without limitation: being outbid; a board closing at midnight; a message being removed under section 04; changing your mind; or deciding the amount was more than you meant to spend.
What you are buying is delivered the instant the payment settles: the message moves, and it is on the public board straight away. By paying you are asking us to begin immediately, and you accept that once we have begun you lose any statutory right of withdrawal or cooling-off period — to the extent the law where you live allows that right to be given up. Where it does not, the right still stands and we will honour it.
A payment buys position on a public leaderboard at the moment it settles. Position is temporary by design — anyone may outbid you a second later, and the Today board clears every 24 hours. That is the product, not a fault in it.
How the board is ordered: highest total first. Where two messages hold the same total, the one that reached it earlier ranks higher — a later bid has to exceed a total, not match it. Taking #1 outright therefore costs at least one dollar more than the current leader.
A single payment may move a message by at most $10,000. The one exception is taking #1: if the leader is further ahead than that, you may always pay what it takes to pass them, because a cap that made the top spot unreachable would be a worse rule than no cap at all.
Amounts are charged in US dollars through Dodo Payments, which acts as the merchant of record and appears as the seller on your statement. Any sales tax or VAT due where you live is included in the amount shown — the price on the board is the price you pay. If your card is issued outside the US, your bank converts and may add its own fee, which we neither set nor receive.
We never see or store your card details. Dodo Payments handles them.
Because Dodo Payments is the merchant of record, its own refund and chargeback policy applies to every transaction and takes precedence over this section. Nothing here removes any right you have to dispute a charge with Dodo or with your bank.
Raising a chargeback without a basis for it is, though, a breach of these terms. If you do, we may take down the message the payment moved and decline to take money from you again. None of that applies to a real dispute: if a charge is wrong, or you did not make it, write to us first and we will help you sort it out — that is faster than a bank is, and it is what the address at the bottom of this page is for.

Your message, your responsibility
You keep ownership of what you write, and you grant us the right to display it publicly on CuBid and in previews of it. You are responsible for having the right to post it.
Report anything that should not be here. Reports are read; not every one results in a removal.
If someone brings a claim against us because of something you posted — a person named in it, a rights holder, anyone — that claim is yours to answer. You agree to cover our reasonable costs and losses in dealing with it, including legal fees. This applies only to claims arising from your own message and only to the extent the claim is not our fault.

Other people's messages
We do not write the messages here and we do not check them for truth. A message is the view of whoever posted it, and publishing it is not us agreeing with it, verifying it, or vouching for anyone named in it.
We host what other people write, which under Indian law makes us an intermediary rather than the author of it. What we owe you is a working way to report a message and a genuine look at what you report — not a guarantee that nothing objectionable ever appears.
We are not responsible for what another user posts, for what they do, or for anything that happens between the two of you off this site.

No guarantees
CuBid is provided as it is and as it happens to be available. We do not promise it will run without interruption, that a rank will last any length of time, that a board will roll over on the exact second, or that data will never be lost.
Beyond what is written in these terms, we give no warranties of any kind, express or implied — including any implied promise that the site is fit for a particular purpose or of satisfactory quality.

Limits on liability
We are not liable for indirect or consequential loss: lost profit, lost opportunity, lost data, wasted time, or distress caused by a message someone else wrote or by a rank you did not keep.
Where we are liable, our total liability to you for everything combined is limited to the amount you have paid us in the thirty days before the claim arose.
None of this applies where the law does not allow it. Nothing here excludes our liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be excluded — and nothing here takes away a right you have under the consumer law of the country you live in.

Changes
These terms may change. If they change in a way that matters, the date at the bottom of this page changes with them. Continuing to use CuBid after a change means you accept it.
A payment already made stays governed by the terms that were in force when you made it, unless the law requires otherwise.

The usual small print
If any part of these terms turns out to be unenforceable, the rest of them still stand. The part that failed is read down to whatever the law does allow, rather than taking its neighbours with it.
Not enforcing something once is not giving it up for good. You may not transfer your rights under these terms to anyone else. We may transfer ours if CuBid changes hands.
These terms, the privacy policy, the rules shown in How it works, and what you are told at checkout are the whole of the agreement between us about CuBid. If the rules and these terms ever disagree, these terms are the ones that count.
